User-generated Content Terms of Service

Simmons Bedding Company, LLC (“Simmons”) provides you an opportunity to share photos of your Beautyrest products and how you Get Your Beautyrest. If you want to participate, here’s what you need to know:

• Who Can Participate: You must be 18 or older to participate.
• Take a Photo: Take a photo featuring your Simmons Beautyrest product. Please make sure that your photo doesn’t prominently feature any company names or trademarks (except for Simmons and/or Beautyrest trademarks). Please also make sure that your photo doesn’t infringe anyone’s rights or include any inappropriate content. Your photo may include people and/or pets, as long as you have explicit permission from the individual pictured and/or owner of the pet pictured.
• Submit Your Photo: Visit Beautyrest.com and follow the instructions to upload your photo. Otherwise, you can upload your photo to Instagram or Twitter with one or more of the following hashtags (where appropriate): #GetYourBeautyrest, #NakedMattress, #BeautyrestPets. Remember to check your privacy settings to make sure we can see your photo.
• Your Photo is Yours: By uploading a photo you automatically represent and warrant that the photo was taken by you, is original, and does not violate the rights of anyone else. In addition, by uploading a photo, you automatically agree to release and hold Simmons, its parent, affiliates, agents, licensees, and assigns harmless from any liability or other damages based on the use of your photo.
• Rights to Photos: You do not transfer ownership of your photo by submitting it. However, you do grant Simmons an irrevocable, perpetual (non-exclusive), royalty-free right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your photo — along with your Instagram or Twitter username and profile picture (in Simmons’ sole discretion) — in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you.
• What We’ll Do: We’ll select various photos to feature on our website, social media accounts, or other places. We can’t promise that we’ll use yours, but keep checking to see if your photo is featured and what other people have submitted. We reserve the right to post and remove any photos at any time in our sole discretion. If we do use your photo, we may link back to your original post on Instagram or Twitter. That will allow members of the public who click on your photo to see other content that you’ve posted.
• Other Details: We reserve the right to terminate this campaign at any time. You agree that any and all disputes arising out of, or connected with, this campaign shall be subject to the laws of Georgia and resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Atlanta, Georgia.
